Terms and Conditions of Sale

1. Who we are

hobbyhorse-shop.com is operated by:

Referred to below as "we", "us" or "the Seller". The customer is referred to as "you" or "the Buyer".

2. Scope

These terms govern every sale made through hobbyhorse-shop.com. By placing an order you confirm that you have read and accepted them. They apply to consumers, meaning natural persons acting for purposes outside their trade or profession. We may update these terms at any time; the version in force is the one published on the site on the day your order is placed.

3. Products

We sell hobby horses (stick horses) and related accessories. Product photographs, sizes and colours are given in good faith and as accurately as possible, but minor variations are normal: our horses are partly handmade, so mane length, stitching and shade of fabric can differ slightly from one unit to another. These variations are not defects.

Our hobby horses are recommended for children aged 3 and over and are not designed for children under 36 months. They are intended for play and hobby horsing practice, not as riding equipment or safety gear. Adult supervision is recommended for young children.

Offers are valid as long as the products are displayed on the site and stock lasts.

4. Prices

Prices are shown in euros (or in the currency selected via the country selector) and include VAT where applicable. The currency converter is provided for information; the final charge is made in the currency shown at checkout.

Shipping is free worldwide on every order unless stated otherwise at checkout. We reserve the right to change prices at any time, but the price applied to your order is the one displayed when you place it.

For deliveries outside the European Union, customs duties, import taxes and clearance fees may be charged by your local authorities. These are not included in our prices and remain payable by you.

5. Orders

You place an order by adding items to your cart, entering your delivery and billing details and confirming payment. The sale is concluded once we send you an order confirmation by email. Please check your details carefully before confirming: we are not responsible for a delivery failure caused by an incomplete or incorrect address.

We may refuse or cancel an order in case of an obvious pricing error, suspected fraud, a payment problem, an abnormal order volume, or a previous dispute with the same customer. In that case we refund any amount already charged.

6. Payment

Payment is due in full when the order is placed. We accept the payment methods displayed at checkout, which may include credit and debit cards, Shop Pay, PayPal, Apple Pay, Google Pay and Klarna. Payments are processed by our payment providers over a secure connection; we never store your full card details.

Your order is only processed once payment is authorised. If payment is declined or reversed, the order is cancelled automatically.

7. Shipping and delivery

Orders are prepared within 1 to 3 business days. Estimated delivery times after dispatch:

  • France and European Union: approximately 6 to 12 business days
  • Rest of the world: approximately 8 to 16 business days

These times are estimates, not guarantees. They exclude weekends, public holidays and delays caused by the carrier or by customs. A tracking number is sent by email once your parcel leaves our warehouse.

Risk of loss or damage passes to you when you or a third party designated by you takes physical possession of the goods.

If your order has not arrived within 30 days of dispatch, contact us at hobbyhorse.support@gmail.com and we will open an investigation with the carrier. In line with Article L216-6 of the French Consumer Code, if we fail to deliver within the agreed time or within 30 days of the order, you may cancel the order after asking us in writing to deliver within a reasonable additional period, and we will refund you in full.

Parcels delivered visibly damaged should be refused or signed for with written reservations, and reported to us within 3 days with photographs.

8. Right of withdrawal (14 days)

If you are a consumer resident in the European Union, you have 14 days from the day you receive your order to withdraw without giving any reason, under Articles L221-18 and following of the French Consumer Code.

To exercise this right, tell us clearly before the deadline expires, by email to hobbyhorse.support@gmail.com. You may use the model form below but it is not compulsory. We will acknowledge your request and give you the return address.

You must return the goods within 14 days of informing us. Return shipping costs are at your expense, unless the item is faulty, damaged or not what you ordered, in which case we cover them. Items must be returned complete, unused and in their original packaging. You are liable for any depreciation resulting from handling beyond what is necessary to establish the nature and characteristics of the product.

We refund all sums paid, including the standard outbound delivery cost where one was charged, within 14 days of recovering the goods or of receiving proof of dispatch, whichever is earlier. The refund is made using the same payment method you used, at no cost to you.

9. Our 30-day return policy

On top of the statutory 14-day withdrawal right, we offer a commercial return period of 30 days from delivery. The same conditions apply: the product must be unused, complete and in its original packaging, and return shipping is at your expense unless the item was faulty, damaged or incorrect. This commercial policy does not affect your statutory rights.

For hygiene reasons, and unless the item is faulty, we cannot accept returns of products that have been visibly used, washed, cut, trimmed or customised.

10. Legal warranties

All our products come with the statutory warranties provided by French law, at no extra cost and independently of any commercial guarantee:

  • Legal warranty of conformity (Articles L217-3 and following of the Consumer Code): you have 2 years from delivery to report a lack of conformity. You may ask for repair or replacement, and if that is impossible or disproportionate, for a price reduction or cancellation of the sale. For the first 24 months, you do not have to prove that the defect existed at delivery.
  • Warranty against hidden defects (Articles 1641 and following of the Civil Code): you may choose between cancelling the sale or obtaining a price reduction, within 2 years of discovering the defect.

These warranties do not cover normal wear, damage caused by misuse, accident, modification of the product, or failure to follow care instructions.

To make a claim, email hobbyhorse.support@gmail.com with your order number, a description of the problem and photographs.

11. Intellectual property

All content on hobbyhorse-shop.com, including texts, product descriptions, photographs, logos, graphics and the site structure, is protected and remains our property or that of our licensors. Any reproduction, republication or commercial use without our prior written consent is prohibited.

12. Personal data

We process your personal data to handle your orders, provide customer support and, with your consent, send you marketing emails. Processing complies with the GDPR. You have the right to access, correct, delete and port your data, and to object to its processing: write to hobbyhorse.support@gmail.com. Full details are in our Privacy Policy.

13. Liability

We are liable for the proper performance of the contract under the conditions set by law. We are not liable for damage caused by improper use of the product, by use that does not match its intended purpose, or by events beyond our reasonable control (force majeure), including natural disasters, strikes, carrier failures, customs blockages and interruptions of the site.

The site may be temporarily unavailable for maintenance or technical reasons without giving rise to compensation.

14. Complaints and dispute resolution

For any question or complaint, contact us first at hobbyhorse.support@gmail.com. We answer within 2 business days.

If no agreement is reached, you may refer the matter free of charge to a consumer mediator, in accordance with Article L612-1 of the French Consumer Code: [name and website of the mediation body we are registered with, to be completed].

The European Commission's Online Dispute Resolution platform was discontinued on 20 July 2025. Consumers with a cross-border dispute can contact the European Consumer Centre France (www.europe-consommateurs.eu).

15. Governing law

These terms are governed by French law. Nothing in this clause deprives a consumer of the protection afforded by the mandatory rules of the country where they habitually reside. Failing an amicable settlement, the competent courts are those designated by the applicable rules of procedure.
